GENERAL TERMS AND CONDITIONS FOR THE CERRITA’S WEBSITE

CERRITA PTE. (“CERRITA”), with registered address, 80 ROBINSON ROAD #02-00 SINGAPORE is a curated medical tourism marketplace whereby users can discover and book medical treatments with international medical providers.

By using CERRITA’s Services, you, the user (“User”) agree to these General Terms and Conditions (the “Terms”).

1. Scope of CERRITA’s Services

1.1 CERRITA is a service platform which purpose is the provision of a marketplace for medical service providers, including but not limited to, hospitals and clinics (“Providers”)

1.2 CERRITA does not refer the User or other patients to specific Providers but only provides information about Providers based on the User’s needs, i.e. time frame of availability, geographic area, medical needs, etc. Thus, the User will not be allocated to any Provider but will instead be provided with a selection of Providers (including the name, address, specialization, etc.) of which the User can choose one and book an appointment with.

1.3 CERRITA discloses details and information on Providers based on data, either provided directly by Providers or content generated by its previous Users. Although CERRITA is committed to keeping information on its website accurate and updated, CERRITA cannot guarantee that, all information provided is accurate, complete or correct, nor can CERRITA be held responsible for any errors (including manifest and typographical errors), inaccurate, misleading or untrue information provided by the Providers or non-delivery of information by the Providers. The website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level or qualification of any Provider.

1.4 CERRITA channels and thereby facilitates the communication between the User and Providers. CERRITA provides different forms the User may use in order to enquire about the Provider’s medical services. Should the User and the Provider decide to conclude a contract, CERRITA is not involved in the contractual relationship between the User and the Provider and also in no way influences the conclusion or the content of the contract. CERRITA does not assume any rights, obligations or liabilities vis-a-vis the User out of a contract concluded between a Provider (or another third party) and the User.

1.5 CERRITA does not provide medical services itself. The information provided on CERRITA’s website including the information provided by the Providers and other third parties cannot replace a medical consultation or a medical examination and shall not be used to independently decide whether to commence or terminate a medical treatment.

2. Conclusion of Contract

2.1 The use of CERRITA’s Services requires the User to provide personal contact details in order for CERRITA or Providers to be able to assist the User with the medical travel facilitation services. The User will have to (i) provide his or her full name and phone number, email address and (ii) agree to these Terms and (iii) to CERRITA’s privacy policy (“Privacy Policy”).

2.2 CERRITA Services are free for the User.

2.3 Once the User requests for booking appointments with Providers via CERRITA, meaning that CERRITA has arranged a set time and date for an appointment for the User with the Provider, the User agrees and intends to attend booked appointments at specified Provider locations. The User will then receive an automatic confirmation email regarding the receipt of the electronic booking which does not, however, constitute the binding acceptance of the order.

2.4 The User may request to remove their submitted personal, specific personal and medical data from CERRITA databases at any time by sending an email to [email protected] In compliance with the Privacy Policies, CERRITA will delete or block the personal data and specific personal data of the User as soon as the User has requested to do so. However, for the purpose of being able to trace and document the history of inquiries of the User or Providers in the event of any legal disputes related to Providers contacted by the User via CERRITA’s platform, CERRITA will keep the first and the last name of the User and his or her email address. CERRITA will not use this data for any other than the aforementioned reason, in particular not for any promotional purposes, after such a request from the User.

3. Payments and Hold Fees

3.1 CERRITA processes all payments made through its platform via a third party payment provider.

3.2 In order to secure a booking with a Provider or the time of a treating physician, CERRITA may require the User to provide a Credit Card Hold Fee (“Hold Fee”), which is a sum at which is reserved on your Credit Card in case of no shows. The Hold Fee would only be charged if the User failed to show at the appointment at the predetermined place and time, CERRITA will process the transaction and deduct the Hold Fee from the User’s Credit Card.

3.3 CERRITA will communicate and charge the respective Hold Fee amount to the User and keep the Hold Fee in its non-interest-bearing trust account until the User cancels the treatment or has successfully attended the predetermined appointment.

4. Cancellation Policy

4.1 The following cancellation clauses should apply, if the User decides to cancel giving no further explanation to CERRITA:

(i) The User may cancel the treatment free of charge at the latest 15 days prior to the appointment.

(ii) Should the User cancel the treatment 8 to 14 days prior to the appointment, a cancellation fee of USD 20.00 applies.

(iii) Should the User cancel the treatment up to 7 days prior to the appointment or should the User not show up at the appointment, a cancellation fee of USD 30.00 applies.

4.2 The User may cancel the treatment free of charge if:

(i) A physician determines that the User is not eligible for the treatment (the User should provide CERRITA up to two (2) weeks after cancellation, a physician’s certificate stating the User’s non-eligibility to treatment);

(ii) A physician determines that the User is not eligible for travel (the User should provide CERRITA up to two (2) weeks after cancellation a physician’s certificate stating the User’s non-eligibility to travel);

(iii) In case of natural catastrophes such as earthquakes, or wars; or

(iv) In case of death (automatic cancellation).

4.3 The User may reschedule the treatment free of charge if:

(i) The User may reschedule the appointment up to three (3) times and up to three (3) days prior to the appointment.

(ii) Should the User reschedule the appointment later than three (3) days prior to the appointment time, or should the User not show up at the appointment, the cancellation fee of USD 30.00 applies.

4.4 If the User wishes to review, cancel or reschedule his or her appointment, the User should revert to the confirmation email and follow the instructions therein. Notes regarding the cancellation or rescheduling of an appointment should name the full name of the User, the respective Provider, the treatment as well as the date and the time of the treatment and should be submitted by email to: [email protected]

5. Data Protection

5.1 For the Services provided by CERRITA, it is necessary to collect, process and use personal data , which requires the prior consent of the User. Please refer to CERRITA’s Privacy Policies explaining under which circumstances User’s data are collected, processed and used when using CERRITA’s Services.

5.2 The User may use this website and the information on it only for the User’s non-commercial, personal purposes.

5.3 All content of CERRITA’s website is protected by copyright and intellectual property rights and partially originated from third parties. All intellectual property rights in the website (including text, graphics, software, photographs and other images, videos, sound, trade marks and logos) are owned either by CERRITA, the Providers or third parties. When using the Services, the User is not granted with any licenses of CERRITA’s intellectual property rights with respect to Services rendered and information provided by CERRITA. Any utilisation not permitted by the copyright law requires advance written approval from CERRITA. Downloads and copies of content from CERRITA’s website are only allowed for private and non-commercial use.

5.4 CERRITA is entitled to use the information, inquiries and communications (e.g. to and with Providers) provided by the User or contributions made by the User in forums et cetera for CERRITA’s business provided that this use shall comply with the applicable data protection regulations.

6. Patient and Medical Provider Relationship

Appointments between the User (also referred to as, the Patient) and the Medical Provider through the Cerrita.com appointment system is a contract created between the Patient and the Medical Provider. The Medical Provider is responsible for responding to and resolving any complaints made by its patients. The User acknowledges that CERRITA PTE. LTD. has no responsibility or liability for the relationship between the Medical Provider and its patients and further has no obligations arising from the relationship between the Medical Provider and the Patient.
